Methods and approaches to regulation of the emerging quantum communications industry in the context of modern information society

The purpose of the study is to identify modern methods and approaches to regulating the emerging industry of quantum communications in the context of modern information society. Quantum communications is one of the critical areas of the developing data economy and the digital economy, which determines the technological development of the national economy in terms of creating high–speed data transmission and processing networks, creating systems for their protection, and ensuring information security. Modern Russian and foreign studies of the legal nature of quantum communications indicate the lack of a common understanding of both the legal essence and the optimal way and mechanism of regulating quantum communications. This problem is extremely important, since the introduction of quantum communication technologies into the system of state and municipal management, the development of commercial use by industry enterprises and, accordingly, the mass introduction of quantum communication technologies depend on it. In this regard, it is relevant to develop approaches and methods for regulating relations in the field of using technologies of secure quantum data transmission systems for further development of a model of optimal legal regulation of quantum communications.
