Abstract

The article is devoted to research on legal aspects of human personality digitization. A classification of the civil states of a digital personality has been developed. The issue of granting legal capacity and ability to virtual individuals is considered. The role of the intellectual property involved in the digitization of human consciousness has been investigated. Particular attention is paid to the problem that arises in preparation for the creation of a digitized person based on a physical predecessor. The problem of independence and security of virtual individuals from the point of view of copyright issues has been analyzed. The conditions for the licensing of proprietary and free software, ensuring the proper degree of independence and security of the digitized person, are formulated. It is proposed to develop a specialized license for proprietary software that has been created with the purpose of digitizing the human consciousness.  The types of free and open source licenses that can be applied for regulation of relations between the customer and the provider of personal digitalization services are defined.
