Abstract

Achieving Russia's national development goal of "Technological Leadership" provides for the accelerated development of advanced technologies, which primarily include quantum technologies, including quantum communications technologies. One of the most important tools for ensuring such leadership is the transformation of the current Russian legal system, flexible legal regulation, including innovative tools. The latter are primarily applicable to the latest technological trends, which are just beginning to be recognized by legal science. Among them is the field of quantum communications. The purpose of the article is to analyze advanced foreign practices in regulating quantum communications and develop proposals based on it for improving Russian legislation and law enforcement practice in the field of quantum communications, as well as to search for other mechanisms for regulating relations in the field of quantum communications. The analysis of foreign experience indicates the active implementation of experimental legal regimes for new technologies, including quantum communications. These innovative legal instruments make it possible to quickly solve the problem of effectively regulating new relationships that do not fit into existing legal models. The mechanisms of ethical and technical regulation are also actively used. self-regulation, which can also be used in Russia. The research methodology includes comparative legal analysis and legal modeling to substantiate proposals for Russian regulators.
